Our client, a mid-sized tech company, noticed a sudden increase in the number of competitors launching similar products, often just weeks after their own products hit the market. Suspecting corporate espionage, the company contacted Resolve Legal Solutions to look into the matter.
We met with the client and their lawyer at their offices to conduct a scoping meeting. We identified several lines of enquiry and a number of persons of interest. As we do in all cases, we carried out a Legitimate Interest Assessment to determine whether a lawful reason existed to conduct these enquiries. All our investigations are lawful and ethical and we will not do anything which does not conform to these.
Within 48 hours of the scoping meeting, we provided the client with a detailed proposal of work, our Terms of Business and a cost estimate all of which is valid for 14 days for the client to take time to read and consider. We were duly instructed to commence our enquiries.
We started by interviewing all employees and examining company security protocols and systems. Very early into our investigation we discovered that a recently hired employee had unauthorised access to sensitive information.
We conducted some background checks and enquiries on the employee, uncovering that they had previously worked with several of the company’s competitors. Surveillance revealed that this employee was meeting with individuals from a rival company outside of work hours and we were able to record the contents of their discussion were the employee disclosed this sensitive information and also handed over documents. We also discovered encrypted emails on the employee’s work computer, which, once decrypted, contained detailed information about upcoming product launches that had been shared with the competitor.
We provided the company with a comprehensive report and file of evidence, including surveillance footage and the decrypted emails. The employee was terminated, and the company took legal action against the competitor.
Our investigation identified a number of vulnerabilities in the company security protocols and systems. We were able to advise them on how to improve security to prevent any future breaches. We also recommended a programme of security training be implemented to raise awareness on security and better prepare staff to be vigilant and understand how to report concerns in the future.
